Topic: COBRA Subsidy, ARRA, CHIPRA, GINA and HIPAA – What Does It Mean to Employer Sponsored Benefit Plans?

Presentation Summary: With a plethora of recently enacted legislation, employers, legal administrators and HR professionals are tasked to implement and comply with a wide range of new and amended federal statutes and regulations. Notably, the American Recovery and Reinvestment Act requires immediate compliance and implementation of COBRA subsidy requirements. This presentation addresses COBRA requirements as well as other critical legislation influencing the administration of employer benefit plans.
Members will receive a basic overview of the following legislation and will learn how these new and amended laws may affect the administration of benefit plans and wellness programs.
- American Recovery and Reinvestment Act (ARRA) – Learn the basics of the COBRA Subsidy and the IRS guidelines released March 31 regarding compliance
- Mental Health and Addiction Equity Act of 2008 – Does your health plan provide equivalent coverage for mental health and addiction based services?
- Children’s Health Insurance Program Reauthorization Act of 2009 (CHIPRA) – What is a CHIPRA Special Enrollment? What notification responsibilities are required from employer sponsored plans?
- Genetic Information Nondiscrimination Act (GINA) – how will this new law affect my responsibilities as a plan sponsor?
- HIPAA -- the new stimulus package imposes significant new Health Insurance Portability and Accountability Act (HIPAA) privacy and security requirements on health plans. Are you prepared?
Karen R. McLeese is Vice President of Employee Benefit Regulatory Affairs for CBIZ Benefits & Insurance Services, Inc., a division of CBIZ, Inc. She serves as in-house counsel, with particular emphasis on monitoring and interpreting state and federal employee benefits law:

v Monitors federal and state legislation impacting employee benefits.
v Provides information in response to technical questions regarding employee benefits.
v Provides technical support in response to employee benefit issues.
v Follows and analyzes trends in employee benefits.
v Monitors case law impacting employee benefits.
Karen received a Bachelor of Arts degree from the University of Notre Dame and her Juris Doctor from Duke University.
She is a member of the Employee Benefits Committee for both the Kansas City Metropolitan Bar Association and the Missouri Bar Association. She is also a member of the Kansas Bar Association, and the Health Law Forum and Labor & Employment Law Sections of the American Bar Association.
